Terms of Use for Pensionsportalen

§ 1 General provisions
Once you have been set up as a user of Pensionsportalen, you will get personal access to the portal. Access is only available to users who, according to the company pension agreement, are entitled to use Pensionsportalen by agreement with Velliv. You are obliged to prevent access by unauthorised persons and must therefore keep your login details confidential. In the event of access by unauthorised persons, you may be held liable, and you may be excluded from using the pension portal in the future, see the section below concerning your obligations and responsibilities.

The agreement concerning the use of Pensionsportalen is a separate agreement which has no amending effect on the terms and conditions applicable from time to time to the underlying company pension agreement and the obligations arising therefrom.

In order to access the portal, you as a user need to be defined by a role and assigned access, see section 3. Roles and access.

Although your access to Pensionsportalen is personal, it is a company-specific access that requires the conclusion of a company pension agreement or framework agreement with Velliv.

Access may also be granted to brokers and others who manage a company’s company pension agreement with Velliv. Such brokers, etc. will be subject to the same terms of use, including obligations arising from the underlying company pension agreement or framework agreement and/or independent agreement with Velliv.

§ 2 Use
Pensionsportalen will be regularly updated with new features, and access will enable you to view information about the company pension agreement and the individual employees’ pension schemes, register and deregister/remove employees, make salary and contribution changes, report periods of leave, change employee groups and view the history of activities performed.

It is the user’s responsibility to ensure that information, including user information, etc., is up to date and correct at all times.

§ 3 Roles and access
Your user agreement includes being assigned a specific role and access when you sign up on Pensionsportalen.

You are responsible for notifying us of any changes that require your role and access to be updated or terminated. If you fail to inform Velliv of the change, Velliv may immediately close and terminate access to the pension portal as regards your specific access, but also as regards other access that the company has to Pensionsportalen.

§ 4 Breakdown or other system failure
In the event that the pension portal is unavailable, for example due to breakdown or other sudden system failure, Velliv will strive to restore access as quickly as possible. However, this does not affect your responsibility to comply with your obligations under the company pension agreement/framework agreement, etc. entered into between the company and Velliv, including, for example, information about resignation, salary changes, etc.

Velliv assumes no liability for the unavailability of the services of the pension portal due to breakdown or other system failure.

§ 5 Obligations and responsibilities
You are obliged to comply at all times with the terms and conditions following from the company pension agreement and its appendices, including with respect to the entering of salary and contribution changes, resignation, etc. See also section 9. Responsible use of Pensionsportalen.

§ 6 Access to the pension portal
You log into the pension portal using your MitID Erhverv.

When registering, you need to provide us with your Universal Unique Identifier (UUID) number, which is your unique ID. You will find the UUID on your user profile via your administrator portal for MitID Erhverv.

Once you have registered using our registration form and received confirmation from us, you will have access to Pensionsportalen.

§ 7 Technical requirements
Access to Pensionsportalen requires a standard browser with internet access. Microsoft Edge and Google Chrome 9.0 and later versions are supported. Microsoft Explorer is not supported. You can access Pensionsportalen at www.velliv.dk.

§ 8 Amendment of Terms of Use
Velliv may change the Terms of Use for Pensionsportalen at one month’s notice. The change will normally be communicated via Pensionsportalen. If you do not wish to be bound by the new Terms of Use for Pensionsportalen, you must inform us before expiry of the notice period, after which the agreement and your access will terminate at the time the new rules take effect.

The termination will not change the obligations imposed on the company under the company pension agreement, including, for example, information about salary and contribution changes and resignation.

§ 9 Responsible use of Pensionsportalen
9.1 Your responsibility as a user
Your access to Pensionsportalen is personal, which means that you must not share your login details (username and password) with any other person. It is not possible to authorise others to use your access.

It is your responsibility that information, including user information etc., is up to date and correct at all times. You are also subject to the terms and conditions that follow from the underlying company pension agreement or framework agreement and/or independent agreement with Velliv, as well as the terms of use for www.velliv.dk.

9.1.2 Unauthorised access
If you discover or suspect that someone else has gained unauthorised access to the portal, you must inform Velliv immediately.You or the company shall be liable for any unauthorised access as a result of someone else using your login details (username and password) and:

• You failing to notify us immediately after you have discovered that someone else has become aware of your login details.
• You providing your login details to the person who has gained unauthorised access to the pension portal without you realising or having ought to have realised that there was a risk of unauthorised access.
• You providing your login details to the person who has gained unauthorised access to Pensionsportalen and you realising or having ought to have realised that there was a risk of unauthorised access.
• You having facilitated the unauthorised access by grossly negligent conduct.
• You acted fraudulently, wilfully or by gross negligence having failed to fulfil your obligations to protect your login details, including by blocking your access to Pensionsportalen.

The rules applicable to MitID, including the rules for storing user IDs and passwords, can be found in the Rules for MitID for private websites and public digital signature, which are available at www.mitid.dk.

9.2 Velliv’s responsibilities as a provider
Velliv offers Pensionsportalen and related services and makes them available on an ‘as is and found’ basis. Velliv makes no warranty with respect to Pensionsportalen or its content, and it is the user’s responsibility that information, including user details, etc., is up to date and correct at all times.

Velliv is not responsible for any incorrect entries or incorrect use of Pensionsportalen or related services. Velliv assumes no liability for incomplete or incorrect information or for the fulfilment of obligations under the underlying company pension agreement, framework agreement or independent agreement with Velliv.

Velliv accepts no liability for any cost, loss or damage occurring as a result of the use of Pensionsportalen and related services or service interruptions that prevent or interrupt the use of Pensionsportalen.

Velliv accepts no liability for any equipment used, e.g. computer, software, router, etc.

However, Velliv may be held liable under the general rules of damages in Danish law for any losses or costs arising as a result of error or omission on the part of Velliv.

§ 10 Termination of agreement and termination of access to Pensionsportalen
In the event of signs of, suspicion of or gross misuse of Pensionsportalen and the related services, Velliv may immediately terminate the agreement and terminate access to Pensionsportalen. Renewed access will require a new agreement with Velliv.

Velliv may also terminate the agreement and cease to offer Pensionsportalen with related services at one month’s notice.

As a user, you can terminate the agreement to use Pensionsportalen without notice. Your access will be immediately closed and the agreement terminated. Termination of the agreement will not change obligations of the underlying company under the company pension agreement or framework agreements.

§ 11 Additional terms
In addition to the abovementioned terms, terms of use for Velliv.dk apply, which are available on Velliv’s website.

Velliv is also entitled to log and check information on the site, including your conduct etc.

Velliv may also automatically register IP addresses and the user’s use of Pensionsportalen.

§ 12 Proprietary rights
Copyright and all other rights in the software etc. used for Pensionsportalen belong to Velliv or others with whom Velliv has entered into an agreement. The software etc. may not be copied, assigned, transferred, disclosed or otherwise made available to others.

§ 13 Governing law
The above terms and conditions are subject to Danish law, and any disputes arising out of or in connection with the content of Pensionsportalen or services offered in connection therewith must be resolved by the Danish courts.

§ 14 Complaints and reporting of failures etc.
You must report any experience of failures in Pensionsportalen or other irregularities, including any signs of unauthorised use or misinformation, to us as soon as possible, see, among other things, section 9. Responsible use of Pensionsportalen.
